The Chair opened the hearing on SB138 at 3:46pm.

Jason Thompson, Office of Revisor of Statutes, gave the bill brief. (Attachment 4)

Proponent Todd Thompson, Leavenworth County Attorney, testified that this bill protects citizens from unreasonable intrusion and the risks of misuse and potential irreparable harm that the current version of the statute creates. As a byproduct, this bill also protects law enforcement agents from being forced to execute a warrant regarding a matter that may not be appropriate to pursue at that time.  (Attachment 5)

Proponent Aaron Breitenbach, Deputy District Attorney, on behalf of Marc Bennett, District Attorney, 18th Judicial District and the Kansas County and District Attorneys Association.  He testified that the minor revision to this bill seeks to ensure the user of a search warrant remains limited to those recognized as having a limited but legitimate need to use it: duly sworn members of law enforcement. (Attachment 6)
