Establishing the removal of squatters act, providing a procedure to remove a squatter from a dwelling unit, requiring owners or agents of dwelling units to provide an affidavit to the county sheriff, requiring notice to vacate by the sheriff, establishing the crime of providing a false affidavit and establishing a civil cause of action for wrongful removal of a person from a dwelling unit, allowing attorney fees and punitive damages.

The Chairman opened final action on HB2378.

Kyle Hamilton, Office of the Revisor of Statutes, gave a briefing on the bill. The bill regards squatters.

Representative Resman offered an amendment (Attachment9)which would implement suggested changes from the sheriff association, requesting a notarized affidavit, false information on affidavit, immediate family member is defined, and included law enforcement officers in addition to the sheriff.

Representative Resman moved, seconded by Representative Howell to pass the amendment as proposed. Motion carried.

The Chairman asked for discussion.

Representative Sanders moved ,Representative Ward seconded to pass HB2378 as amended. Motion carried.

The Chairman closed the hearing on HB2378.
