Ms. Moyer responded to questions from the committee.
Lacey Hunter, Commissioner, Survey, Certification & Credentialing, Kansas Department for Aging and Disability Services, provided testimony in support of HB2316 (Attachment 4). The bill creates a civil monetary penalty fund which redirects current civil monetary penalties from the state general fund (SGF) into a newly created fund. This fund will be utilized to award grants to providers to enhance the health, safety, and welfare of the residents/clients they serve. The bill will not increase the number of citations written by KDADS. Passage would ensure providers have access to the funds received by the state for regulatory infractions and reinvest these funds into the the health, safety, and welfare of residents, patients and clients. An example was provided.

Kylee Child, Director of Government Affairs, LeadingAge Kansas, provided testimony in support of HB2316 (Attachment 5). Currently CMS-certified nursing homes have a civil monetary fund distributed by the federal government. Currently, state-licensed-only facilities lack access to similar grant funds. Creating such a fund would enhance resident care. Given the small scale, Ms. Child proposed two amendments for the bill, which were provided to the committee.
