Amending the Kansas drycleaner environmental response act to modify the penalties for violations of the act, the required deductible rate for corrective actions, the environmental surcharge rate, the solvent fee and the delinquency penalty related to environmental surcharges and solvent fees.

Kate Gleeson, Deputy Director of Environment, Kansas Department of Health and Environment (KDHE) spoke in support of SB184 which is a revision to the Drycleaner Enviromental Response Act. (Attachment 2)

The surcharge and deductible are the two primary changes proposed in SB184. The surcharge was set in 1995 at 2.5%, meaning for every ten dollars spent on drycleaning, the consumer pays 25 cents in the Trust Fund. This bill proposes changing that fee to 5%. SB184 increases the deductible from $5,000 to $10,00.
