Minutes for HB2084 - Committee on Taxation

Chairperson Smith opened the hearing for HB2084.

Adam Siebers, Office of Revisor of Statutes, provided an overview for HB2084 (Attachment 13).  Mr. Siebers stood for questions from Committee members.

Kathleen Smith, Kansas Department of Revenue, provided an overview on the fiscal note for HB2084 stating the bill would decrease the State General Fund revenues by $15.8 million in FY 2026 and in each future year. To formulate the estimate, the Department reviewed Internal Revenue Service data on gambling losses claimed on federal tax returns. Ms. Smith stood for questions from Committee members.

Proponents:

Jason P. Watkins, Golden Circle, testified as a proponent for HB2084 allowing gambling losses claimed on federal income tax returns to be claimed as an itemized deduction on state income tax returns in tax year 2025 and in each future tax year.  Mr. Watkins provided an example of how HB2084 would work whether it be paramutuel, sports wagering, or in a casino. HB2084 reinstates the deduction and puts Kansas on a more level tax structure with states that have gambling and parimutuel wagering and that allows for this deduction (Attachment 14). Mr. Watkins stood for questions from Committee members.

Carol Kinderknecht, Kansas citizen, testified as a proponent for HB2084 noting the bill addresses pivotal legislation aimed at realigning the state of Kansas' tax treatment of wagering losses with federal guidelines. The bill represents a step toward equitable tax legislation ensuring a balanced and supportive economic environment  Ms. Kinderknecht stated HB2084 needs to be retroactive to January, 2025. (Attachment 15).  Ms. Kinderknecht stood for questions from Committee members.
