Chairperson Petersen called the meeting to order a 8:31 a.m. and opened the hearing on SB97.
Assistant Revisor Adam Siebers briefed the Committee on the bill; he explained that the bill grants purchasers of nonhighway vehicles the option to obtain a nonhighway certificate of title. He said currently nonhighway vehicles are exempt from registration under Kansas law; however, such vehicles are required to obtain a nonhighway certificate of title upon sale or transfer of such vehicle in the county where the buyer resides (Attachment 1).
Senator Stephen Owens, District 31, testified as a proponent for the bill (Attachment 2). He related the disparate answers he received when asking the Kansas Department of Revenue and a county official whether state law requires a nonhighway vehicle to be titled. He stated that the proposed bill will clarify the law by giving the purchaser the option for obtaining a certificate of title.
Senator Owens responded to members' questions:
- Some lending institutions require a title before making a loan; others do not.
- Even if a stolen nonhighway vehicle does not have a title, it can be identified by a VIN or serial number.
- A bill of sale can also be used to identify a nonhighway vehicle.
- A bill of sale does not require registration and would not be pertinent for any attempt to track a nonhighway vehicle history.
