Enacting the fast-track permits act to require local governments to meet specified deadlines for issuing building permits and other required approvals for real estate development.

The Chair opened the Hearing on HB2088 by asking Charles Reimer, Revisor, to provide a brief of HB2088 regarding a fast track review for housing, commercial and industrial building permits.   He stood for questions.

Tanner Temple, Deputy State Director, Americans for Prosperity Kansas, provided Oral Proponent Testimony. He noted that HB2088 limits permitting delays and subsequent costs, streamlines government processes and mirrors "shot clock" legislation in other states.  He stood for questions.(Attachment 1)

James M. Manley, State Policy Chief, for the Pacific Legal Foundation provided Oral Proponent Testimony.  He noted that HB2088 was a step in streamlining permitting processes.He stood for questions.(Attachment 2)

Andrew Wiens, with Dugan Counsulting Group, on behalf of Opportunity Solutions Project, provided Oral Proponent Testimony.  He noted that bill would streamline local permits.  He stood for questions.(Attachment 3)

Eric Stafford, VP of Government Affairs, Kansas Chamber.(Attachment 4)

Nathan Eberline, Executive Director, League of Kansas Municipalities, provided Oral Opponent Testimony.  He noted that the Constitutional Home Rule provides cities with local control to make zoning and permitting decision.  He stood for questions.(Attachment 5.)

Rhiannon Friedman, City of Topeka provided Oral Opponent Testimony.  She noted among other issues, that the 15-day timeline for requesting re-submittals is problematic since it includes week end days as part of the 15 days.  She stood for questions.(Attachment 6) 

Jay Hall, Deputy Director and General Counsel, Kansas Association of Counties provided Oral Opponent Testimony.  He noted that permitting and approval of land use is not an application, it is a process. He stood for questions.(Attachment 7)
