Chairwoman Warren opened the hearing on SB30.
Natalie Scott, Office of Revisor of Statutes, provided an overview of the bill and stood for questions. (Attachment 1)
Amber Shultz, Kansas Secretary of Labor, Department of Labor (KDOL), provided testimony in support of the bill. KDOL would like to continue participating in the Treasury Offset Program (TOP), administered by the United States Department of the Treasury through the Internal Revenue Service. The IRS requires that any employee with access to the Federal Tax information to have passed a federal background check. If the employee does not have this federal background check, the KDOL cannot participate in TOP. SB30 would fulfill those requirements and allow the KDOL to utilize this important tool to combat unemployment insurance fraud by recovering fraudulently obtained benefits. (Attachment 2)
Bob Stuart, Executive Officer, Kansas Bureau of Investigation supports this bill. SB30 will require the Secretary of Labor to conduct fingerprint based criminal history record checks on employees who have access to federal tax information. The KBI offers criminal history record checks to both criminal justice and non-criminal justice entities. The KBI is in support of this legislation to ensure that the employees who are working on the Treasury Offset Program have completed the appropriate level of record check to protect Federal Tax information. (Attachment 3)
