The Chair opened the the hearing on HB2025.

Revisor Jason Long briefed the Committee on the bill (Attachment 1). He explained that the bill would limit cities' authority to apply planning and zoning regulations outside city limits.

Representative Ken Corbet, District 54, testified as a proponent for the bill (Attachment 2). He explained that this bill removes the 3 mile circle where cities have complete control over all zoning issues.

Beth Salmans, citizen, testified as a proponent to the bill (Attachment 3).  She expressed concerns about being governed by boards and other officials without being able to vote for those officials.

Angel Cushing, citizen, testified as a proponent to the bill (Attachment 4) (Attachment 5)  She asked for help to stop discrimination of farmers and restore their representation by removing city control over county landowners.

Sheri Grogan, President Leavenworth Inc., testified as a proponent to the bill (Attachment 6). She explained that affected citizens view this an an overreach.

Desree Su Pettera, citizen, testified as a proponent (Attachment 7). She stated that she has no representation in the 3 mile zone.

Representative Bergquist asked if there was any one else that would like to speak as an proponent.

Andy Pettera, citizen, testified as an opponent oral only, he is concerned that if he sells his cows and won't be able to put any back on his land at a later date.

Written proponent testimony was submitted by the following people:

Mike Taylor, Kansas County Commissioners Association, testified as neutral to the bill. (Attachment 32). He requested that the bill be moved to an interim committee for further study.

Jay Hall, Kansas Association of Counties, testified as neutral to the bill (Attachment 33). He requested that an interim committee study the issues further.

Trey Cocking, City Manager, Emporia testified as an opponent to the bill (Attachment 35).  He explained that the bill represents an unnecessary restriction on local authority and threatens the ability of communities like Emporia to plan for their future effectively.

Spencer Duncan, League of Municipalities, testified as an opponent to the bill(Attachment 36). He asked that the committee vote "no" with the caveat of requesting an interim committee to further examine the issue.

Kimberly Svaty, Kansas Municipal Utilities, testified as opponent to the bill (Attachment 37). She explained that maintaining a safe, reliable utility offering electric, natural gas, water and wastewater service and thus changes to the three-mile language could have unintended impacts on utility service in the community and within the three-mile zone.

Dan Warner, City of Topeka testified as an opponent. (Attachment 38). He explained that if a county resident is upset with the current regulations in the three mile ETJ (extraterritorial jurisdiction), there is a remedy in current law through their elected representatives on the county commission.

Jim Benage, Mayor, City of Bel Aire, testified as an opponent (Attachment 39). He explained that changing the law comes with significant consequences and a change of this magnitude needs significant study before consideration.

David Dillner, City Manager, El Dorado testified as an opponent via WEBEX (Attachment 40) He explained his concern about the proposal to eliminate this essential tool because doing so would undermine the ability to thoughtfully plan for growth, protect property values, and maintain the quality of life that is residents expect.
