Decreasing the rate of ad valorem tax imposed by a school district.

Chairperson Smith opened the hearing for HB2011.

Mr. Siebers provided an overview for HB2011 that decreases the rate of ad valorem tax imposed by a school district from 20 mills to 18.5 mills for school year 2025-2026. The bill also provides for further deductions in future years (Attachment 3).

Mr. Siebers stood for question from Committee members.

Kathleen Smith, Kansas Department of Revenue, provided the fiscal impact of HB2011. The Department of Revenue estimates that the enactment of HB2011 would decrease revenues to the State School District Finance Fund by $67.4 million in FY2026, $113.8 million in FY2027, $162.4 million in FY2028, $213.3 million in FY2029, and $266.7 million in FY2030. 

Ms. Smith stood for questions from Committee members.

Proponents:

John Donley, Kansas Farm Bureau, testified as a proponent for HB2011.  Kansas Farm Bureau supports a state tax, fee, and revenue mix that does not increase the dependency property tax to fund K-12 education (Attachment 4).

Aaron Popelka, Kansas Livestock Association, testified as a proponent for HB2011 that will increase reliance on income tax and other non-property tax sources for support of local school districts and reducing the reliance on property tax revenues.(Attachment 5)

Daniel Murray, National Federation of Indpendent Business, which represents 3,600 members across the state testified as a proponent for HB2011.  He noted 88 percent of NFIB members support reducing property taxes, like the statewide property tax mill levy, local ad valorem rates and other property taxes.  (Attachment 6)

Opponent:

Written testimony was submitted as an opponent by Nathan Kessler, Kansas Action for Children (Attachment 10).

Neutral:

Shannon Kimball, representing the Kansas Association of School Boards testified as neutral to HB2011.  She stated the Kansas Association of School Board members would like sustainable and reliable funding for public schools and also property tax relief efforts that do not risk school funding (Attachment 11). 

Ms. Kimball stood for questions from Committee members.

Timothy Graham, Director of Government Relations and Legislative Affairs, testified as neutral to HB2011 noting KNEA is not opposed to property tax relief. The concern with HB2011 that reduces the statewide levy from 20 mills to 18.5 mills is a direct reduction to the revenue for public education.  KNEA would ask the Legislature to include language that makes it 100 percent clear that the intent of HB2011 is a property tax reduction and not to cut funding. (Attachment 12)
