Chairperson Petersen opened the Hearing on HB2606. Adam Siebers, Staff Revisor gave an explanation of the bill. (Attachment 8) There were no questions.

Zach Denney gave proponent testimony on HB2606. (Attachment 9) He stated that the intent of this bill is to align Kansas law with federal commercial driver's license (CDL) regulations. KDOR introduced this bill to ensure Kansas statute mirrors federal regulations and to clarify that a CDL may be suspended for a DUI violation even when the driver enters into a diversion agreement, consistent with longstanding policy. 

Catherine Magana spoke in support of the bill. (Attachment 10) She said that passage of this bill is critical to keep the state in compliance with federal regulations regarding DUI offender penalties for CDL users. The bill makes a simple language change in one location of existing state law, allowing the state to continue to suspend CDLs due to the presence of a prior DUI.

They took questions from committee members. Technical Trooper Nick Wright who was in the audience was available for questions and provided additional information.
