Proponents:

Marc Bennett, District Attorney, 18th Judicial District, testified that this bill would close a gap in our ability to hold repeat DUI offenders accountable, particularly when they kill or seriously injure others. HB2747 provides a simple solution to this injustice. By incorporating language already interpreted and applied by the Kansas Supreme Court into Kansas Sentencing Guidelines Act special rules 41, 42, and 44, we will help ensure repeat DUI offenders who do the most harm face the greatest consequences.  (Attachment 4)

Jerry Carter, Private Citizen, shared the story of the experiences of their family related to the death of their daughter, Officer Sidnee Taylor Carter of the Sedgwick County Sheriff's Office, who was killed in the line of duty due to a driver convicted of a DUI who had two prior DUI convictions. The prior convictions could not be used in sentencing.  (Attachment 5)

Jeff Easter, Sedgwick County Sheriff, for the Kansas Sheriffs Association, testified that this bill would allow for prior convictions for DUIs in municipal courts or equivalent courts in other states to be used for sentencing purposes in a DUI case that caused great bodily harm or death.  (Attachment 6)
