Charles Bradley provided proponent support to the bill on behalf of the  Kansas Department of Revenue. Up until recently, Kansas Department of Revenue (KDOR) understood that the Kansas statute mirrored federal commercial driver's license (CDL) regulations based on the definition of "conviction". A recent Kansas Court of Appeals decision found that the inclusion of the word "and" in K.S.A. 8-2,128(h) substantially changes the meaning and intent of the statute. KDOR has introduced this bill to ensure that Kansas statute mirrors federal regulations and clarifies that a CDL may be suspended for a Driving Under the Influence (DUI) violation even when the driver enters into a diversion agreement. (Attachment 3)

Catherine Magana provided proponent testimony to the bill in that it provides a minor language clarification to Driving Under the Influence (DUI) statutes. This would keep the state in compliance with federal regulations regarding DUI penalties for CDL users. (Attachment 4)
