Jason Thompson presented a brief on HB2713 explaining that it is as amended by the House committee and includes new law that repeals former acts and provisions related to notaries public. He went into detail about which sections have been changed and what the changes do. One large change is the creation of requirements and guidelines for remotely located individuals using communication technology. (Attachment 10)
The fiscal note presented to the House Committee was provided for the Committee. (Attachment 11)
Randy Barbour spoke in support of HB2713 explaining that uniform law has been updated several times since Kansas last adopted a uniform notarial law. It is time to bring Kansas law current with other states. He requested two amendments to update sections of the bill before the Committee. (Attachment 12)
James Concannon spoke in support of HB2713, as amended, explaining that the new law allows for changes in technology and authorizes remote notarization. It also clarifies law regarding notaries public, their responsibilities and duties,and provides a framework for performing notarial acts with respect to electronic records. This harmonizes the treatment of notarization of all records and preserves the integrity and reliability of notarized documents. (Attachment 13)
