Short Title
Amending the Kansas power of attorney act regarding the form of a power of attorney and the duties of third parties relying and acting on a power of attorney.

Jason Thompson gave a brief of HB2500 explaining that it would amend the power of attorney act to state that a power of attorney executed on or after July 1, 2020, would be deemed sufficient if in substantial compliance with the form set forth by the Judicial Council, and it would direct the Judicial Council to develop such a form. The bill also states that amendments made by the bill would apply prospectively and would not affect the validity of a power of attorney executed prior to July 1, 2020. The bill limits the ability of third parties to refuse to accept valid powers of attorney or to require completion of their own power of attorney form. (Attachment 10)

Mark Knackendoffel spoke as a proponent of HB2500 explaining that it will promote the use of durable powers of attorney and will limit use by unscrupulous parties. This bill also gives penalties to refusal to acknowledge a power of attorney. (Attachment 12)
