The Chair opened the hearing on HB2524.
Mr. Siebers provided a briefing for the bill. He explained that the bill would update statutes related to the Kansas Corporation Commission's (KCC) regulatory authority in regard to motor carriers. It would remove various requirements by the KCC to establish a uniform system, receive reports, hold hearings, and provide other oversight actions; the bill would clarify that motor carriers are subject to state regulations when not preempted by federal law.
Mike Hoeme, Director of Transportation, Kansas Corporation Commission, testified as a proponent. He said that the bill removes outdated regulations and introduces updated language that is relevant to federal rules (Attachment 4).
Tom Whitaker, Executive Director, Kansas Motor Carriers Association, speaking as a proponent, explained that the bill removes pre-deregulation language from the statutes. He noted that the KCC included the Association in assessing Chapter 66 of the state statutes to bring the statutes up to date (Attachment 5).
Mr. Whitaker and Mr. Hoeme responded to members' queries:
- KCC sends documents by standard mail, but uses e-mail for interoffice communication.
- When federal regulators began deregulation in 1982, many of the requirements assigned to the KCC became irrelevant.
The Chair closed the hearing on HB2524.
