Chairperson Bowers opened the hearing on SB423. Mike Heim, staff revisor, presented a briefing on the bill. After questions by the Committee were addressed, the hearing continued.
Jim Howell testified in support of SB423 on behalf of the Board of the Sedgwick County Commissioners. Mr. Howell indicated this bill is very narrowly focused, just for Sedgwick County for the unincorporated part of the county. Mr. Howell further indicated this is just simply trying to get a tool at the end of the process that says if you don't do what you need to do on health and safety issues, we can step in at some point and solve this so that your neighbors aren't negatively impacted by your decisions. Christopher W. Labrum testified in support of SB423. Mr. Labrum indicated this legislation is not an intent to expand their reach, change their process in any way; it is an additional tool to help them in the most extreme cases. Mr. Labrum explained the goal of their code compliance program is always compliance, so the lengthy process emphasizes due process and the goal is always compliance. Mr. Labrum indicated they would seek this as a last resort and to ensure the health and the safety welfare of their public and citizens. (Attachment 4)
