Clayton Perkins testified in opposition of HB2518 on behalf of the Kansas Association of Criminal Defense Lawyers (KACDL). (Attachment 8)
He stated there are four reasons to oppose this bill:
- The domestic violence designation applies to property crimes.
- Attorneys have not been treating the domestic violence designation like it will be used to enhance domestic batteries.
- HB2518 could interact poorly with State v. Fowler and K.S.A. 21-6810(d)(10).
- HB2518 is likely unconstitutional.
