The Chair opened the hearing on SB356.
Mr. Siebers explained that the bill would amend the classification of commercial Class A, Class B, and Class C drivers' licenses to include gross combination weights.
Kent Selk, Driver Services Manager, Division of Vehicles, Kansas Department of Revenue, testified as a proponent for the bill (Attachment 2). He stated that the bill adds the term or gross vehicle weight and gross combination vehicle weight to the definition of gross vehicle weight rating, an action that will align the statute with federal regulations.
Members discussed at length whether or not a driver who holds a Class C driver's license could incur two fines if the vehicle is overweight--one for a license violation and the other for an overweight vehicle. Tom Whitaker, Executive Director, Kansas Motor Carriers Association, explained that the driver in such a situation would only incur a driver's license infraction fine unless the vehicle or combination vehicle weight exceeded 42,000 lbs. He also noted that being out of compliance with federal regulations could reduce federal funds to the state.
