Chairman Olson opened the hearing on the bill and called upon Eileen Ma for au Revisor of Statues overview on the bill.
Ms. Ma provided the review and a table outlining the Peer to Peer Vehicle Sharing Act. (Attachment 1)
Chairman called upon Art Diaz for the primary proponent testimony. Mr. Diaz explained that the bill would provide a framework to recognize peer-to-peer car sharing arrangements and to protect Kansas consumers regarding issues of safety and insurance coverage. Mr. Diaz explained the bill was based upon National Council of Insurance Legislators (NCOIL) model legislation and referenced a balloon amendment attached to his testimony. (Attachment 2)
Chairman Olson called upon William Sneed for additional proponent testimony on the bill as he proposed it to be amended. (Attachment 3)
Chairman Olson called upon Kathy Taylor for proponent support on behalf of the banking industry. She expressed support of the measure that would address insurance coverage and notices given to owners and drivers of peer-to-peer vehicle sharing. (Attachment 4)
Chairman Olson called upon Mark Johnson for proponent testimony. Mr. Johnson described this conversation as the beginning of the debate. Mr. Johnson pointed out that while it is almost completely based on the NCOIL model he pointed out how it differs. He referenced his balloon amendment attached to his testimony. (Attachment 5)
Chairman Olson called upon Larrie Ann Brown for further proponent testimony. Ms. Brown applauded that the bill tracked the NCOIL Model and she encouraged other proponents to fully conform to the model. (Attachment 6)
Chairman Olson recognized John Peterson to answer a committee member question regarding rental car and airport applications of the bill.
Chairman Olson recognized Lee Modesitt to step up to answer a committee question regarding current regulations in this area.

Chairman Olson called upon Aaron Mays to provide opponent testimony to the bill. Mr. Mays applauded the original NCOIL model legislation. He expressed concerns about the proposed amendments. (Attachment 9)
Chairman Olson called upon Lauro Manno for further opponent testimony. Ms Manno explained that her constituents are people who use their private vehicles to earn extra income averaging about $175 per month. She expressed concerns about the definitions, double taxation and redundant airport language. She emphasized that upon passage of this bill as is, it would represent a significant barrier to entry for the people she represents. (Attachment 10)
Chairman Olson called upon Pat Barnes for neutral testimony. Mr. Barnes explained why automotive dealers be exempted from this bill. (Attachment 11)
Chairman Olson requested Mr. Peterson to sit down with all the parties present and attempt to develop an agreeable compromise.
Chairman Olson closed the hearing on the bill.
