Short Title
Enacting the Kansas taxpayer protection act; requiring the signature and tax identification number of paid tax return preparers on income tax returns; authorizing actions to enjoin paid tax return preparers from engaging in certain conduct.

Adam Siebers provided an overview for HB2466 which would enact the Kansas taxpayer protection act. The bill would require a paid tax return preparer to sign and include their federal Internal Revenue Service Preparer Tax Identification Number on each tax return they prepare. Certified Public Accountants (CPAs) would be excluded from the requirements of the Kansas Taxpayer Protection Act. He noted there are civil penalties if a tax return preparer fails to sign or include their identifying number which is $50. per violation with a maximum of $25,000.
In response to a question, Mr. Siebers stated CPA's would be excluded from the bill.
In response to a question, Kathleen Smith, Kansas Department of Revenue said HB2466 discourages a paid tax return preparer from preparing tax returns that would defraud the state.
Jeremy Stohs, Director Government Relations, H&R Block testified as a proponent for HB2466 noting the bill will prevent unethical tax return preparers from harming taxpayers and defrauding the state. If a preparer is identified violating the provisions of the bill, the Department of Revenue could prohibit the tax preparer from being a preparer in the state and would be subject to penalties and fines (Attachment 1).
In response to questions, Mr. Stohs noted the Tax Preparer ID is different from the Federal Employer ID and not a certification that the preparer is qualified to prepare tax returns. There have been successes in Louisiana, Minnesota, Missouri and 14 others states with laws like HB2466. He stated similar bills are being considered in several other states.
