The Chair opened the hearing on HB2125.
Mr. Siebers stated that the bill amends the statute so that the holder of a driver's license who is operating a motor vehicle promptly deliver--rather than display-- the license upon demand by an officer.
Mr. Klumpp testified as a proponent of the bill (Attachment 4). He explained that under current law a driver may refuse to provide a driver's license to a law-enforcement officer or may choose to display it through the window, the latter response making it difficult for an officer to access the bar code on the license or to properly record the license information. Mr. Klumpp noted that the bill is divided into two subsections to clarify that a driver must not only possess a valid driver's license, but must present--not display--the license to law-enforcement personnel.
Responding to questions, Mr. Klumpp replied that if an officer requests a driver's license from an individual, if the individual can produce another form of identification, the officer usually will not give the person a ticket. However, with the passage of this bill, the officer would have the option to arrest the individual who could not produce any form of identification.
