Short Title
Allowing all-terrain vehicles to cross federal or state highways.

Staff explained the bill. Chairman Proehl recognized Representative Highland as the first proponent. (Attachment 7) According to Representative Highland this matter was brought to his attention by constituents in his district. He said their property is bisected by a State highway and they routinely use the highway to check on irrigation, cattle and harvesting. It was brought to their attention by a Highway Patrol Trooper who told them they could not use their all-terrain vehicles on the highway or they would be ticketed.
The next proponent was Tucker Stewart. (Attachment 8) He said the Kansas Livestock Association supports HB2248 because this bill will help farmers and ranchers access property that is divided by a highway. The current law would have them drive a vehicle allowed on state and federal highways with an ATV in tow to check cattle, crops and other agricultural activities.
The last proponent was Ryan Flickner. (Attachment 9) He said the ATVs provide an efficient and common-sense way for farmers and ranchers to go from one tract of property to another. He said Kansas Farm Bureau strongly supports a statutory change explicitly stating ATVs used for agricultural purposes are implements of husbandry because that is what they are used for on agricultural operations. Mr. Flickner said this bill would legally allow ATVs to cross federal and state highways.

Chairman Proehl announced the next meeting would be Thursday, February 21st and the Committee would hear one bill and do Final Action on five bills.
