Chairperson Vickrey opened the hearing on HB 2053
The chairperson noted that the following proponents had previously provided testimony regarding this bill and the related AHP bills:
Will Larson, Attorney, Kansas Association of Insurance Agents in support of the related AHP bills (See December 30, 2019, minutes).
Mark Dugan, Opportunity Solutions Project in support of the related AHP bills (See December 28, 2019, minutes).
There being no other proponents, the chairperson asked if there were any opponents.
Jordan Feuerborn, American Cancer Society Cancer Action Network, provided written testimony in opposition to the bill. She said they had opposed previous federal initiatives to encourage the growth of short-term limited duration plans because these plans might deny coverage to individuals with preexisting conditions, choose to not cover services related to those pre-existing conditions, or charge enrollees higher premiums because of their preexisting conditions (Attachment 4).
The chairperson asked if there was any neutral testimony to the bill.
Lee Modesitt, Kansas Insurance Department, said they were neutral on the bill. It was the Commissioner's policy to leave policy decisions to the policy makers. He provided to the members a side-by-side comparison of the new Federal rule to current Kansas Statutes (Attachment 5).
The chairperson asked if there were any questions. Questions were asked and answered regarding: lifetime or limits to the short-tern limited duration plans and consumer protections. Representative Bishop asked whether the bill pertained to ERISA. Revisor Ma answered it did not.
There being no further questions, Chairperson Vickrey closed the hearing on HB 2053.
The chairperson asked for approval of the minutes. Representative Frownfelter moved, Representative Cox seconded that the minutes for January 16 and January 23 be approved as presented. Motion carried.
The meeting was adjourned at 3:55 p.m.
