Authorizing the Kansas department for aging and disability services to condition or restrict a disability service provider license, granting the secretary authority to grant regulation waivers unrelated to health and safety and authorizing correction orders and civil fines to be appealed to the secretary.

Chairperson Gossage opened the hearing on HB2751.

Eileen Ma, Staff Revisor gave an overview of the bill. (Attachment 1) There were no questions.

Lacey Hunter gave proponent testimony for HB2751. (Attachment 2) She stated that HB2751 addresses a gap in the statutory authority of the Secretary of Kansas Department for Aging and Disability Services (KDADS) under the Kansas Administrative Procedures Act as part of the agency regulatory authority. KDADS anticipates the statutory clarifications in HB2751 will help avoid delays in the review or additional regulation updates by aligning to the standard practices used by other agencies and clarifying the Secretary of KDADS authority.

Chris Stanyer testified in support of HB2751(Attachment 3)  He said Goodwill Industries of Kansas stands in support of HB2751 and the proposed amendment to clarify the definition of Day Service Provider.
