Minutes Content for Tue, Feb 6, 2024

Proponent
Ron Nelson stated Kansas' statutes governing third-party visitation were consolidated in the 2012 re-codification, but the policies in the statutes have not been updated in 40 years, since 1984. After reviewing Kansas' current third-party visitation statues, case law, and the Uniform Non-parent Custody and Visitation Act (UNCVA), the Committee recommends Kansas' third-party visitation statutes be replaced with the modified version of the UNCVA as presented in 2024 HB2675. This bill provides a more comprehensive and standardized act to govern non-parent visitation than do the current more open-ended statutes. The proposed act is designed to be compatible with existing custody, residency, and parenting plan statutes in Chapter 23, Article 32. It also protects parents' fundamental rights while recognizing that third-party visitation is necessary for children in certain situations. Mr. Nelson stood for questions. (Attachment 18)
