Short Title
Enacting the Kansas public investments and contracts protection act concerning environmental, social and governance (ESG) criteria, prohibiting the state and political subdivisions from giving preferential treatment to or discriminating against companies based on such ESG criteria in procuring or letting contracts, requiring KPERS fiduciaries to act solely in the financial interest of the participants and beneficiaries of the system, restricting state agencies from adopting ESG criteria or requiring any person or business to operate in accordance with such criteria and providing for enforcement of such act by the attorney general.

Chair Hoheisel called for discussion and final action HB 2436, recognized David Wiese, Senior Assistant Revisor, who provided a review of HB 2436. A brief question and answer period followed.
Chair Hoheisel announced a balloon amendment on HB 2436 and requested David Wiese, Senior Assistant Revisor to explain the Hoheisel-KPERS-Treasurer amendment. (Attachment1)
Representative Nick Hoheisel moved to adopt the amendment, seconded by Representative Bill Clifford. The motion passed on a voice vote.
Chair Hoheisel announced another balloon amendment on HB 2436, recognized Rep. Xu who explained the Xu "solely" amendment. (Attachment2)
Representative Rui Xu moved to adopt the amendment, seconded by Representative Tom Sawyer. The motion passed on a voice vote. Representatives Lewis, White, Donohoe, Smith and Schmoe requested their "nay" votes be recorded.

Representative Bill Clifford made a motion to favorably pass HB 2436 as amended. The motion was seconded by Representative Carl Maughan and passed on a voice vote.
