Chairperson Owens opened the hearing on SB73. Natalie Scott provided an overview of the bill. (Attachment 2)
Will Hurst, Johnson County Assistant District Attorney testified in support of the bill on behalf of the Kansas County and District Attorneys Association. Mr Hurst has led the domestic violence prosecution unit within their office for approximately the last four years. He said this bill addresses a loophole that needs to be fixed in order to protect some of the most vulnerable members of our community. He shared a recent example regarding a defendant who was charged in Johnson County to illustrate the current issue this bill would help address. (Attachment 3) Mr. Hurst responded to questions from committee members.
Ed Klumpp testified in support of the bill on behalf of Kansas Sheriffs Association, Kansas Association of Chiefs of Police, Kansas Peace Officers Association. He said he thought it would be helpful to give the law enforcement perspective on this bill. Domestic battery continues to be a major crime of violence and violations of protection orders are too often an ingredient in these crimes. One of the big issues they have is the lack of teeth when people violate protection orders. (Attachment 4) Mr. Klumpp responded to questions from committee members.
