Chairperson Waymaster opened the hearing on SB42.

Murl Reidel, Fiscal Analyst, Kansas Legislative Research Department, provided an overview of SB42, the Joint Committee on Special Claims Against the State's recommendations for payment. (Attachment 1)

Murl Reidel stood for questions. Chairperson Waymaster raised concerns about the number of malfunctioning security gates on state property, and whether or not drivers had insurance of their vehicles and submitted claims to the insurance company, resulting in a claim for the deductible amount and not a claim for the damages. The response was that claimants did not provide documentation of submitted claims to their insurance company and received compensation from their insurance company or indicating what their deductible would have been. Representative Sutton made inquiry about situations when a state agency is involved in stand-off or shoot-out that damages property that the state is responsible. The response provided was fugitive claims have been heard in the past. Traditionally, the committee has not awarded funding. There are a variety of circumstances considered, such as were they the lead entity or serving in a supportive role and whether a search warrant was present or not. The joint committee came to the conclusion the agency's role was sufficient to compensate the claimed amount. Representative Estes inquired if the claimant in one case made claim to entities other than the state. The response provided was the claimant had checked with his insurance agency and they would not cover this damage, but if claimant was seeking compensation elsewhere it would be difficult for this committee to know.

There was no proponent, opponent or neutral testimony.
