Minutes for SB131 - Committee on Public Health and Welfare

Providing an exemption from licensure requirements for certain out-of-state physicians practicing on a limited basis in the state.

Chairperson Gossage opened the hearing on SB131.

Jenna Moyer, Staff Revisor gave an overview of the bill. She answered questions from committee members.

Senator Jeff Pittman spoke in support of SB131 saying that it give team doctors the ability to accompany sports teams traveling into Kansas without obtaining a license to practice medicine for a short term, when that care is focused on the team members and for the sport event itself. (Attachment 2)

Travis Oller gave proponent testimony for SB131 He stated that SB131, as written, would allow physicians licensed in other states to provide medical care to team members and staff traveling with a team for events happening within Kansas. He is asking for Doctors of Chiropractic to be included in SB131(Attachment 3)

Nicole T. Yedlinsky gave testimony in support of SB131 said that the provisions of SB131 for out-of-state team physicians are limited and temporary. It would only apply to the short duration of time the team would be in Kansas for practice or competition, the sport-specific nature of travel, and restricted to care of the team physicians' athletes and staff. By assuring athletic directors and team management their athletes will be taken care of by their established team physician, SB131 would make Kansas more attractive to collegiate and professional sporting events.  (Attachment 4)

Courtney Cyzman gave neutral testimony on SB131 by stating that their main concern with SB131 is that out of state professionals permitted to practice in Kansas will not be held accountable to Kansas law and that patients will not be protected because the proposed legislation lacks a mechanism by which the board can exercise jurisdiction over those out of state professionals. Proposed solutions to the Board's concerns are 1) consider creating a "Sports Waiver", 2) provide additional clarification and 3) consider increased utilization of the Interstate Medical Licensure Compact o- Physician Compact.  (Attachment 5)
