Scott Brunner, Deputy Secretary, Kansas Department for Aging and Disability Services, provided testimony in support of HB2408 (Attachment 3). This proposal would settle long-standing differing of interpretation and interplay between statutes and regulations between the Kansas Department for Aging and Disability Services and the Kansas Board of Cosmetology. KSA 39-938 exempts adult care homes from following regulations of the Board of Cosmetology and Board of Barbering, however it does not apply to statutes. The proposed change reduces government regulations by clarifying that the beauty and barber shop area of adult care homes and long term care units of hospitals, which are required by KAR 26-40-303, would be exempt from the statutes of Board of Cosmetology (KBOC) and Board of Barbering. This has been an ongoing issue for decades. KBOC was informed that they were required to inspect and license these facilities. The bill would exempt adult care homes and long term care units of medical care facilities from inspection from the KBOC. The beauty shops and barber shops are routinely by KDADS surveyors. At a December meeting KBOC voted to support the change.
Rachel Monger, President and CEO, LeadingAge Kansas, provided testimony in support of HB2408 (Attachment 4). The association supports the resolving of a long standing question around the regulations regarding "beauty shops". While required, regulated and inspected by KDADS and CMS, beauty shops are not required to be licensed salons under the KBOC. These spaces are required to meet the stringent physical environment, health and infection control standards as every other part of a nursing facility. A history of issue was presented. Ms. Monger provided some of the general questions that have arisen regarding beauty and barber shops and the answers to those questions. Ms. Monger provided examples of other uses the beauty shop spaces provide to it residents. These uses would not comply for usage with the KBOC.
The hearing for HB2408 was closed.
Without objection, the committee worked HB2408.
Representative Eplee motioned and Representative Clifford seconded to pass out HB2408 favorably. Motion passed.
