Chairperson Francis opened the hearing on HB2147.
Chris Waggoner, Office of Revisor of Statutes provided an overview of the bill and addressed questions from the committee. (Attachment 1)
Representative Francis Awerkamp, Kansas Legislature, District 61 testified in support of the bill stating that he would defer to the real life experiences of professionals in the salvage yard industry to further highlight the need for this legislation. (Attachment 2)
Representative Awerkamp addressed questions from the committee.
Heather Klamm, A and A Auto and Truck Parts, Inc. testified as a proponent stating that more often than not the requirements of the Possessory Lien Affidavit are not being met prior to the sale of vehicles at public auctions by tow companies which leads to the rejection of title applications by the purchaser. (Attachment 3)
Ms. Klamm addressed questions from the committee.
Steve Denton, President of Denton Auto Salvage testified in support of the bill stating that it is already the tow lot's responsibility to prepare the proper paperwork and have any necessary inspections done prior to the sale of a vehicle to ensure the buyer will be able to obtain a title. Mr. Denton further explained how this legislation would simply require tow lots obtain the title prior to the sale of the vehicle - the cost of which they could pass on to the purchaser. LeeAnn Phelps, Vehicle Services Manager testified in support of the bill on behalf of The Division of Vehicles stating that it properly puts the burden on the seller to have a title prior to the sale which places the purchaser in a much better position to obtain the title. (Attachment 5)

Deann Williams, Executive Director of the Kansas Motor Carriers Association testified in opposition to the bill. Ms. Williams stated that it would unfairly shift the time and expense of titling a vehicle from the Vehicle Salvage Dealer to an already overburdened tow company. (Attachment 6)
Ms. Williams addressed questions from the committee.

Representative Hoye moved to amend HB2298 with the Holliday Street amendment, seconded by Representative Hoheisel. Motion carried. (Attachment 8)
Representative Hoheisel moved to pass HB2298 favorably as amended, Representative Ballard seconded. Motion carried.
