Chairperson Owens called for final action on HB2073. Natalie Scott reviewed the bill.
Representative Maughan proposed an amendment that would remove the mandatory language and make the setting aside of fines and fees discretionary with the judge. (Attachment 1)
Representative Maughan moved, Representative Eric Smith seconded, to adopt the amendment. The motion failed.
Representatives Carmichael, Highberger, Martinez, and Schlingensiepen requested their "Nay" votes be recorded.
Representatives Turk, Maughan, and Adam Smith requested their "Aye" votes be recorded.
Representative Turk proposed an amendment that would ensure that the fines and fees that were converted to civil judgments and already sent to collections would be included and discharged. (Attachment 2)
Representative Turk moved, Representative Thompson seconded, to adopt the amendment. The motion carried.
Representatives Carmichael, Highberger, Martinez, and Schlingensiepen requested their "Aye" votes be recorded.
Representative Owens proposed a technical amendment repealing the child support provisions. (Attachment 3)
Representative Owen moved, Representative Turk seconded, to adopt the amendment. The motion carried.
Representatives Martinez and Schlingensiepen requested their "Aye" votes be recorded.
Representative Owens proposed an amendment that would allow a list of certain people to have access to the expunged records for the purpose of collecting restitution that is owed. (Attachment 4)
Representative Owens moved, Representative Eric Smith seconded, to adopt the amendment. The motion carried.
Representatives Carmichael, Highberger, Martinez, and Schlingensiepen requested their "Aye" votes be recorded.
Representative Eric Smith moved, Representative Schlingensiepen seconded, to recommend HB2073 as amended, favorably for passage. The motion carried.
