Minutes for HB2021 - Committee on Corrections and Juvenile Justice

Short Title

Allowing evidence-based program account money to be used on certain children, requiring the department of corrections to build data systems and allowing for overall case length limit extensions for certain juvenile offenders.

Chairperson Owens called for final action on HB2021.  Natalie Scott provided an overview.

Representative Owens proposed an amendment that would remove technical violations from the list of things a juveniles could be incarcerated for.  (Attachment 3)

Representative Owens moved, Representative Butler seconded, to adopt the amendment.  The motion carried.

Representatives Highberger, Carmichael, Martinez, and Schlingensiepen requested their "Aye" votes be recorded.

Representative Owens proposed another amendment dealing with an electronic management system.  (Attachment 4)

Representative Owens moved, Representative Eric Smith seconded, to adopt the amendment.  The motion carried.

Representatives Highberger, Carmichael, Martinez, and Schlingensiepen requested their "Aye" votes be recorded.

Representative Adam Smith proposed a conceptual amendment that would have the bill become effective upon publication in the Kansas register rather than upon publication in the statute book. 

Representative Adam Smith moved, Representative Thompson seconded, to adopt the amendment. 

After discussion among the committee, Representative Smith withdrew his motion.

Representative Highberger proposed an amendment that would preserve the existing law with respect to detention caps. (Attachment 5)

Representative Highberger moved, Representative Carmichael seconded, to adopt the amendment.  The motion failed.

Representatives Highberger, Carmichael, Martinez, and Schlingensiepen requested their "Aye" votes be recorded.

Representative Highberger proposed another amendment dealing with detention sanctions.  (Attachment 6)

Representative Highberger moved, Representative Schlingensiepen seconded, to adopt the amendment.  The motion failed.

Representatives Highberger, Carmichael, Martinez, and Schlingensiepen requested their "Aye" votes be recorded.

Representative Eric Smith moved, Representative Maughan seconded, to recommend HB2021 as amended, favorably for passage.  The motion carried.

Representatives Highberger, Carmichael, Martinez, and Schlingensiepen requested their "Nay" votes be recorded.

The meeting was adjourned at 2:23 PM.
