Short Title

Allowing businesses to sell cereal malt beverage by the drink on Sundays without requiring that 30% of such businesses’ gross receipts be derived from the sale of food.

Chairperson Carpenter opened the hearing on HB2124.  The revisor provided an overview of the bill (Attachment 1)

Chairperson Carpenter recognized Representative Tory Marie Blew as a proponent on HB2124 (Attachment 2).  She stated that one of her constituents reached out to her about this bill.  He owns a bowling alley and it has bowling leagues on Sundays.  They cannot reach the 30% food requirement to be able to sell beer and cannot get a different type of liquor license since there is a school located across the street so they are requesting this bill be passed. 

Chairperson Carpenter recognized Jason Watkins who testified as a proponent on HB2124 (Attachment 3).  He stated that many rural cities and counties in Kansas have small mom and pop operators of cafes, bowling alleys, taverns, etc. that only have a CMB retailers permit and they are not able to meet the 30% food sale requirement causing them to remain closed on Sundays.  They are asking the Committee to pass this bill.

Chairperson Carpenter noted that there is written proponent testimony from Gary Boxberger (Attachment 4).  He also stated that Debbi Beavers from the Alcoholic Beverage Control Division is here if anyone has any questions.  Representative Highberger had a question for Ms. Beavers.
