Minutes for HB2018 - Committee on Judiciary

Short Title

Permitting a will or a copy of a will filed within six months after the death of the testator to be admitted to probate at any time.

Chairman Patton opened the hearing on HB2018.  Natalie Scott reviewed the bill.(Attachment 7) Ms. Scott addressed questions from the membership.

Larry Rute, on behalf of Tim O'Sullivan, (Attachment 8) stated HB2018 was last year (2022) HB2125 and it passed favorably out of committee passed the House as a Whole, but died in the Senate. Mr. Rute explained The Kansas Bar Association (K.B.A.) Probate, Trust and Real Property Section proposed this bill because it will increase efficiency of probated estates and modernize the estate process. HB2018 would simply modify existing statute K.S.A. 59-618a to clearly provide that a copy of a will may also be preserved for later admission to probate in the same manner as the original of a will, subject to all applicable defenses otherwise applicable to such admission. Mr. Rute stood for questions and asked the membership for their support.

Chairperson Patton closed the hearing on HB2018.
