HB 2406 dealing with the plat approval process provides that if the county does not have a designated county surveyor, the county engineer shall review the plat if the county engineer also is a registered land surveyor. In the absence of both a county surveyor and a county engineer, the plat must be reviewed by a registered land surveyor designated by the county. All cost for plat review and approval shall be charged back to the applicant for plat approval.
The county is made responsible for the enforcement of this act. The county surveyor or county engineer must certify that the plat meets all the requirements of this law. If any plat is required to be submitted to a planning commission for review and approval or disapproval, the review and approval duly certified upon the face of the plat shall not constitute full compliance with the review required by this law unless reviewed by the county surveyor or county engineer.
The Senate Committee amended the bill to exempt counties with a population of 25,000 or less from the provisions of the bill.
Background
The bill was supported by the Kansas Association of Counties, several county officials, and the Kansas Society of Land Surveyors. The Kansas Association of Counties supported an amendment to limit the bill to the counties with 25,000 or more population since concern was expressed that many counties will have difficulty finding a county surveyor.
