HB 2109 concerns lotteries and lottery machines. The major provisions of the bill:
Prohibit the use of video lottery machines or lottery machines by the Kansas Lottery, tribal gaming, and games of bingo.
Require the Kansas Lottery to adopt rules and regulations concerning the game of Keno and require that the time between games of Keno shall not be less than five minutes
Prohibit the sale of lottery tickets by electronic mail, the Internet, or the telephone.
Prohibit lottery retailers from accepting payment for a lottery ticket by credit card.
Prohibit the Kansas Lottery from advertising by electronic mail, the Internet, or the telephone.
Require that all advertising and marketing practices of the Kansas Lottery meet the standards of the North American Association of State and Provincial Lotteries.
Exclude lottery machines and video lottery machines from the definition of "tribal gaming" and "bingo."
Add to the definition of video lottery machine and lottery machine any slot machine, bingo, Keno ticket dispenser, lottery ticket dispenser, pull-tab dispenser, and instant bingo dispenser.
The House Committee amendments are technical in nature.
Background
A representative of Stand Up for Kansas testified in support of the bill. A representative of the Kansas Soft Drink Association expressed the concern that the bill may impact soft drink vending machines. A representative of the Petroleum Marketers and Convenience Store Association of Kansas testified in opposition to the provision in the bill which prohibits the purchase of lottery tickets by credit card.
The fiscal note prepared by the Division of the Budget indicates that the provision in the bill that increases the time between Keno games would result in a loss of the amount of lottery revenue transferred to the State General Fund by $2.9 million in FY 2002.
