HB 2049 repeals two obsolete statutes that specified circumstances under which a school district could obtain a special waiver of the minimum school term requirement:

• •For the 1977-78 school year, when a school district was affected by the persistence of inclement weather that created hazardous driving conditions such that the district was prevented from being able reasonably to adjust its schedule to meet the statutory requirement;

• •For the 1990-91 and 1991-92 school years, when a school district in which a disaster had caused widespread or severe property damage such that the district could not reasonably have adjusted its schedule to meet the statutory requirement.

Background

HB 2049 was requested by the State Board of Education for the purpose of removing an obsolete law from the statute books. The State Board's request addressed the inclement weather situation. In the process of drafting the measure, the Revisor's Office identified a similar obsolete provision, the one concerning the minimum school term exception due to widespread or severe property damage. (The object of this legislation was the Andover and Derby school districts which had suffered severe property damage due to a tornado.)

The House Committee on Education recommended that the bill be placed on the Consent Calendar.

HB 2049 has no fiscal impact.
