SUPPLEMENTAL NOTE ON
SENATE BILL NO. 239

Brief

SB 239, as amended, concerns the
Advisory Committee on Trauma. The bill abolishes the current
Advisory Committee and, on and after July 1, 2001, creates a new
Advisory Committee on Trauma with 24 members, appointed by the
Governor as follows:
- Two members licensed to practice
medicine and surgery -- the Kansas Medical Society will submit a
list of three names of persons of recognized ability and
qualification to the Governor who shall consider the persons on the
list in making his appointments;
- One member licensed to practice
osteopathic medicine -- the Kansas Association of Osteopathic
Medicine will submit a list of three names of persons of recognized
ability and qualification to the Governor who shall consider the
persons on the list in making his appointments;
- Three members representing
hospitals -- the Kansas Hospital Association will submit a list of
three names of persons of recognized ability and qualification to
the Governor who shall consider the persons on the list in making
his appointments;
- Two members who are licensed
professional nurses specializing in trauma care or emergency
nursing -- the Kansas State Nurses Association will submit a list
of three names of persons of recognized ability and qualification
to the Governor who shall consider the persons on the list in
making his appointments;
- Two members who are attendants as
defined in KSA 65-6112 (a first responder, emergency medical
technician, emergency medical technician-intermediate, emergency
medical technician-defibrillator, or a mobile intensive care
technician) who are on a roster of an ambulance service -- the
Kansas Emergency Medical Services Association will submit a list of
three names of persons of recognized ability and qualification to
the Governor who shall consider the persons on the list in making
one of these appointments; the Kansas Emergency Medical Technician
Association will submit a list of three names of persons of
recognized ability and qualification to the Governor who shall
consider the persons on the list in making his appointments; will
submit a list of three names of persons of recognized ability and
qualification to the Governor who shall consider the persons on the
list in making the other appointment under this
section;
- Two members who are administrators
of ambulance services, one rural and one urban -- the Kansas
Emergency Medical Services Association and the Kansas Emergency
Medical Technician Association in consultation will submit a list
of four names of persons of recognized ability and qualification to
the Governor who shall consider the persons on the list in making
his appointments;
- Six members representing regional
trauma councils, one per council -- the relevant regional trauma
council will submit a list of three names of persons of recognized
ability and qualification to the Governor who shall consider the
persons on the list in making his appointments;
- The Secretary of Health and
Environment, or the Secretary's designee shall be an ex officio
representative of the Department of Health and
Environment;
- The Chairperson of the Board of
Emergency Medical Services or the Chairperson's designee shall be
an ex officio member; and
- Four legislators -- the
Chairperson and ranking minority member or their designees of the
Committee on Health and Human Services of the House and the
Chairperson and ranking minority member or their designees from the
Committee on Public Health and Welfare of the Senate.
The bill requires all members to be
residents of the State of Kansas and those preparing lists of
potential members are to give particular attention to rural and
urban interests and geography in an effort to balance
representation. Each congressional district is to have at least one
representative.
Of the members appointed to the
Advisory Committee, not including the ex officio and legislative
members, six shall be appointed to initial terms of two years, six
to initial terms of three years, and six to initial terms of four
years. Thereafter, members serve terms of four years and until a
successor is appointed. The Advisory Committee meets quarterly and
at the call of the Chairperson or at the request of a majority of
the members. At the first meeting after July 1 each year, the
members elect a chairperson and vice chairperson who serve for one
year. The chairperson and vice chairperson serving on the effective
date of this act are reappointed under the act and continue in
their respective offices until the first meeting after July 1,
2002.
Background
SB 239 was requested by the
Department of Health and Environment on behalf of the Advisory
Committee on Trauma. Testimony indicated the need to continue the
Advisory Committee to assist the Department of Health and
Environment to implement the 1999 legislation authorizing the
development of regional trauma councils and a statewide trauma care
plan, and the development and maintenance of a state trauma care
registry.
The House Committee amendments
recreate the Advisory Committee in an expanded form and with clear
lines of appointment and terms of service for the members. The
amendment was developed with the assistance of the Governor's staff
in response to questions raised by the indefiniteness of current
law regarding the appointing process and terms of
members.
