SB 205 amends criminal procedure statutes to require that, unless the judge or magistrate makes a specific finding otherwise, every bond for a person charged with a person offense (misdemeanor) in municipal court or a person felony in district court shall be conditioned on the person upon release from custody being prohibited from having any contact with the alleged victim for a period of at least 72 hours.
Background
The bill was supported by Senator Barnett, several representatives of the City of Emporia, the Kansas Bureau of Investigation, and the Kansas Coalition Against Sexual and Domestic Violence. Proponents said it is sometimes impossible for police offers to verify a "no contact" bond condition under current law since the contact incidents frequently happen at night when the court is closed. The "no contact" bond condition in the statute generally would provide officers with probable cause to make arrests in these situations.
The bill has no fiscal impact.
The House Committee inserted the term "alleged" regarding the victim.
