SESSION OF 2001

SUPPLEMENTAL NOTE ON SENATE BILL NO. 139

As Amended by Senate Committee of the Whole

Brief (1)

SB 139 amends the assumption of risk of domestic animal activity law (KSA 60-4001 et seq.) to include bison in the definition of "domestic animal." The Senate Committee of the Whole amended the bill also to add "any creature of the ratite family, including but not limited to, an ostrich, emu or rhea."

Background

The bill was requested by Senators Jordan, Schmidt, and Schodorf as a result of a tourist site in Southeast Kansas that includes bison as part of a "prairie experience." The assumption of risk of domestic animals law provides the persons who participate in domestic animal activities have been presumed by law to assume the risk inherent in such activities.

The bill would have no fiscal effect.
