SUPPLEMENTAL NOTE ON HOUSE BILL NO. 3021

Brief (1)



HB 3021 would amend the Kansas Tort Claims Act to provide that a governmental entity or an employee acting within the scope of employment will not be liable for damages resulting from the performance of, or failure to perform, any activity pursuant to the statute governing the development of a project of state as well as local importance on a federal enclave. This protection includes, but is not limited to issuance and enforcement of a consent decree agreement and oversight of contaminant remediation and taking title to any or all of the federal enclave. The project to which the law indirectly refers is the theme park proposed by the Oz Entertainment Company to be located at the Sunflower Army Ammunition Plant site.





Background



HB 3021 was requested by the Kansas Department of Health and Environment. The House Committee held a hearing on HB 3021 at which time the Secretary of Health and Environment testified in favor of the bill and a representative of the Kansas Trial Lawyers Association testified in opposition to the bill.



The Budget Division reports that passage of HB 3021 would have no fiscal impact on the state.
