Brief (1)



HB 2756 repeals a statute that creates a 12-member Commission on Epilepsy within the Department of Health and Environment; sets out how members of the Commission are to be appointed and who they are to represent; sets out the duties of the Commission; and requires the Commission to submit an annual report to the Legislature, the Governor, specified heads of state agencies, and the Kansas Affiliate of the Epilepsy Foundation of America.





Background



The statute that is repealed by HB 2756 was enacted in 1990 following the report and recommendations of a task force on epilepsy created by the 1988 Legislature. The initial members of the Commission who were appointed as provided by statute were appointed for three-year terms. The Commission met, carried out the statutory duties assigned to the Commission, and submitted annual reports through 1993 as required by law. Although the statute repealed by HB 2758 originally provided for the Commission to be sunsetted in 1993, the sunset provision was repealed prior to the sunset date. Apparently, neither the state agencies involved as statutory members of the Commission and charged with appointing other members or the Department of Health and Environment were aware of the repeal of the sunset provision. No members were appointed to the Commission on the expiration of the three-year terms of the first members, and the Commission ceased to function. Repeal of the statute creating the Commission was requested by the Department of Health and Environment whose representative was the only conferee on the bill.



Passage of HB 2756 would have no fiscal effect.
