HB 2614 would expand the crime of eavesdropping to include installing or using a concealed camcorder, motion picture camera, or photographic camera of any type to secretly videotape, film, photograph, or record by electronic means, another, identifiable person either nude or under or through the clothing being worn by that other person, for the purpose of viewing the body of, or the undergarments worn by the other person without the consent or knowledge of that other person, with the intent to invade the privacy of that other person, under circumstances in which the other person has a reasonable expectation of privacy.
The House Committee of the Whole amended the bill to include a change in the Sentencing Guidelines Grid whereby, if a felony against a person or property is committed as a hate crime, the offender's sentence would be presumed imprisonment and the sentence will be up to double the maximum duration of the presumptive imprisonment term for the underlying felony. The statute regarding aggravating factors for sentencing purposes is amended to strike the factor governing offenses motivated by the race, color, religion, ethnicity, national origin, or sexual orientation of the victim.
