Sub. for HB 2082 deals with the Office of Administrative Hearings (OAH) to clarify that the Director of OAH has the authority to provide an Administrative Law Judge (ALJ) for Kansas Administrative Procedure Act (KAPA) proceedings as well as non-KAPA proceedings for state agencies and other governmental entities, if requested.
Background
The original contents of HB 2082 dealt with criminal procedure statute of limitations matters.
The substitute bill was prompted by a recent court decision that held that OAH could not provide an ALJ for KAPA proceedings for agencies other than the Department of Social and Rehabilitation Services.
Conferees representing the Kansas Judicial Council appeared in support of the bill.
