As Amended by Senate Committee on

Federal and State Affairs

Brief (1)

SCR 1635 would memorialize Congress to pass a Constitutional Amendment restricting the ability of United States courts to mandate that any state or local government levy or increase taxes.

Background

The Senate Committee held a hearing on SCR 1635 at which time Senator Salisbury, the primary sponsor, testified in favor of the bill. Senator Salisbury noted that in addition to Kansas, 15 states are also urging passage of this proposed constitutional amendment.

The Senate Committee amended the bill to expand the list of recipients of the resolution to include certain members of the federal and state judiciary.
