SB 498, as amended, relates to special orders issued by the State Bank Commissioner. The bill would require all special orders issued by the Commissioner to be published promptly in the Kansas Register.

The Senate Committee amendment deleted language that stated in law the Legislature's authority to modify or revoke any special order issued.

Background

SB 498 continues the discussion of the Commissioner's special order authority begun in the 1999 Session. The bill places no restrictions on that authority; rather, it gives notice to the public that such an order has been issued.

The provision of the bill relating to publication was not opposed by the Community Bankers Association or the Office of the State Bank Commissioner. The provision regarding the authority of the Legislature to modify or revoke an order seemed an unnecessary restatement of the Legislature's authority and was removed.
