SB 483 amends the Code of Civil Procedure regarding service of process by the Secretary of State on business entities. It adds domestic or foreign limited liability companies and domestic or foreign limited liability partnerships; permits the Secretary of State to serve both domestic and foreign corporations and limited partnerships and limited liability companies when the resident agent cannot be located; permits service on the Secretary of State by either personal service or certified mail; and establishes a $40 fee paid to the Secretary of State when providing service of process, which is deposited to the State General Fund.
Background
The bill was supported by the Secretary of State's Office. A proponent said the amendments would create simple uniform standards that allow the Secretary of State's Office to assist with service of process.
The Senate Committee amendments added the $40 fee and made other clarifying amendments.
The fiscal note on the bill, as introduced, indicated no fiscal impact on the state.
