Brief (1)



SB 425 deletes a provision added in 1999 to the Uniform Enforcement of Foreign Judgments Act. The 1999 amendment allows a foreign judgment (from another state) to be enforced in a Kansas court even if the statute of limitations would be a defense if it were a Kansas judgment as long as the judgment could still be enforced in the state where the judgment originated.





Background



The bill was supported by a representative of the Kansas Judicial Council. The representative said that the effect of the 1999 amendment was to make Kansas the only state in the Union that treated foreign judgments more favorably than its own. No plausible Kansas policy purpose could be served by this provision.



The House Committee deleted the Senate Committee of the Whole amendment so the bill reads as it was introduced.



The bill has no fiscal impact.
